Evi Terms of Use

True Knowledge Limited is a company registered in England, Company no. 04660006 whose registered office is: 66-68 Hills Road, Cambridge, CB2 1LA, United Kingdom. (“True Knowledge“).

Use of the Evi Service and software is subject to these terms of use. Users who do not accept these terms of use are not authorised to use or continue their use.

True Knowledge may amend these terms of use at any time and any revised version will be effective immediately that it is displayed on this website.

In this Licence:

we, us and our mean True Knowledge;
Software and Service mean the Evi Software and Service;
Partner and Partners mean any of our third-party partner websites and data providers.
Licence means a non-exclusive, non-assignable, non transferable right to use the Evi Software and Service in accordance with the terms of this Agreement.

INTELLECTUAL PROPERTY RIGHTS OF TRUE KNOWLEDGE

True Knowledge owns or is licensed to use all intellectual property rights in and to this Service and all technical infrastructure relating to it.

Users who submit information to this Service grant True Knowledge a non-exclusive, irrevocable, perpetual licence to use such information to operate this Service and for any other purposes.

THE SOFTWARE

True Knowledge grants the user a non-exclusive licence to download and use the Evi Software on and in conjunction with a Handset/Mobile Device for the sole purposes of access to the Evi Services subject to the terms and conditions contained in this Agreement.

Compatible Phone /Handset – The user may only use the Evi software and Service with compatible handsets or devices identified on our website www.evi.com. True Knowledge is not liable if the user does not have a compatible handset or if the user has downloaded the wrong version of the Software for their handset. True Knowledge reserve the right to cease providing Services and terminate this agreement should the user be using the Evi Service with a handset or device that is not identified on the website as compatible.

To enable the user to use the Evi Service, True Knowledge provides a software application for use with their handset/mobile device, which may downloaded by the user from the Evi website and some partner websites.

The user undertakes not to copy, translate, adapt, alter, vary, modify, disassemble, decompile or reverse engineer the Evi software without True Knowledge’s prior express written consent.

ACCESS TO AND USE OF THE EVI SERVICE

In accessing any part of this Service, users agree:

not to use this Service in such a way that disrupts, interferes with or restricts the use of this Service by other users;
not to upload, display or transmit any materials through this Service which are false, offensive, defamatory, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world;
not to reverse engineer, decompile, copy or adapt any software or other code or scripts forming part of this Service or attempt to transmit to or via this Service any information that contains a virus, worm, trojan horse or other harmful or disruptive component;
not to reproduce, translate, modify, sell, lease, rent, loan, distribute, sub-lease, sub-license or create derivative works of the Software or Service;
not to impair the proper operation of the network;
not to try to harm the Service in any way whatsoever;
not to attempt to gain unauthorised access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or any other means;
use the Software or Service in any manner that might damage, disable, overburden or impair the Software or Service, or third-party computer hardware or software;
not to change, modify, delete, interfere with or misuse data contained on this Service and entered by or relating to any third party user of this Service;
that the Evi Software and Service are only for personal use;
not submit any form of automated or recorded queries unless expressly authorized by True Knowledge in writing;
not perform any other form of high volume usage beyond reasonable personal use and;
that usage of the Service and the Software while driving or performing any other potentially dangerous activity which requires your attention may be distracting and unsafe for the user and other people on the road, and is discouraged. Usage of the Service that involves typing on or looking at the device while driving or performing any other potentially dangerous activity is prohibited. It may also be illegal in your area.
that the Service is neither intended nor suitable for urgent emergency use, and that you will not use it for emergency purposes.
that this Agreement does not allow the user to use the software and Service for commercial purposes, including but not limited to any form of direct or indirect sales or promotional activities.

Material contained in this Service may be downloaded, viewed and printed for personal use or internal circulation within the user’s organisation provided that no trade mark, copyright or other proprietary notices contained in or appearing on such material are removed in whole or in part.

Material contained in this Service may not otherwise be copied, reproduced or redistributed in whole or in part without the prior written consent of True Knowledge. In particular it must not be reproduced or exploited for commercial gain. All other rights are reserved and users must ask permission from True Knowledge before making any other use of material contained in this Service. This permission to reproduce material does not extend to material identified as belonging to third parties, where users must obtain the permission of the relevant owners before reproducing such material.

We reserve the right at any time at our sole discretion to remove any materials and/or information available in this Service. We may also take steps to prevent you using the Service if it appears to us that you are creating problems for other users, exposing us to legal or financial risk and/or are in breach of these terms of use. All other rights are reserved.

If required to use a password to access any part of this Service, users agree:

to ensure that any details supplied to True Knowledge in order to register for such access are accurate and to advise True Knowledge promptly in the event that any such details change; and
to keep confidential any personal login password provided by True Knowledge and to be responsible for any loss or damage resulting from use of any such password by any third party.

True Knowledge reserves the right to terminate the user’s access to password protected parts of this Service if it considers that the user is using this Service in a manner detrimental to this Service or to other users.

SOFTWARE AND SERVICE QUALITY

True Knowledge does not guarantee that the software and Service will be error free or free from interruption or other failures, or that the Software and Service will satisfy your specific requirements.

The Service may be unavailable because of maintenance, upgrades and emergency repairs, failure of telecommunications links and equipment, or other causes that are beyond True Knowledge’s control. True Knowledge will take reasonable steps to minimise disruption to the Service where it is within their reasonable control.

True Knowledge may modify or discontinue temporarily or permanently providing the Service or any of its features with or without notice.

True Knowledge cannot guarantee that the software will be free of all viruses.

Use of the Evi software and Services entirely at the user’s own risk.

WARRANTIES

The Software and Service are made available on an AS IS basis.

If the user has a problem using the Evi Service, True Knowledge will attempt to replicate and verify such non-conformance and if able to do so, will in their sole discretion either issue a fix, patch or try to assist the user to enable use of the Service.

Except as set out above, True Knowledge does not warrant or make any representation:

that the Evi Service will meet the user’s requirements; or
that the operation of the software, Services or links to partners will be uninterrupted or error free.

True Knowledge does not warrant that the software is compatible with all handsets / mobile devices or that it is compatible with all partner Services and software and True Knowledge has no responsibility or liability in relation to the performance or otherwise of third party software.

The user assumes the entire risk as to satisfactory quality, reliability and accuracy associated with the use of the Software and Service.

To the maximum extent permitted by law, True Knowledge makes no warranties of any kind, either expressed or implied, including but not limited to warranties of title or implied warranties of merchantability, quality or fitness for a particular purpose, and non-infringement with respect to the Software and Service.

PRIVACY POLICY

Users who supply personal details to True Knowledge through this Service consent to True Knowledge maintaining, recording, holding and using such personal data in accordance with True Knowledge’s Privacy Policy: http://www.trueknowledge.com/privacy/.

EXCLUSIONS AND LIMITATIONS OF LIABILITY

This Service has been developed with the aim of providing information and does not constitute advice in relation to any situation.

Owing to the nature of the Internet, True Knowledge cannot guarantee that this Service or the Services to which it is linked will always be available to users. Users should ensure that they have appropriate protection against viruses and other security arrangements in place whilst using the Internet.

The Service is designed to return the text that it thinks you spoke. Both humans and automated speech recognition systems such as the Service will misunderstand or misrecognize what people say from time to time. It is your responsibility to verify that the results obtained from the Service are accurate. Occasionally, it may be possible for the Service to misrecognize words you speak and return content that you may find objectionable. True Knowledge shall assume no liability whatsoever with respect to the failure of the Service to correctly recognize any spoken utterances provided to the Service.

We do not verify the content of the materials and information which are supplied to this Service by third parties, over whom we have no control. You acknowledge that we shall have no responsibility for any materials or information displayed within this Service. Although every reasonable effort is made to ensure that the information provided by this Service is accurate at the time of publication, it is subject to variation at any time without notice and True Knowledge gives no warranty whatsoever that any such information will be accurate or complete at any particular time or at all.

This Service and any information or other material contained within it are made available strictly on the basis that the user accepts it on an ‘as is’ and ‘as available’ basis. Where users of this Service rely on any information or other material contained in it, they do so entirely at their own risk and they accept that all warranties, conditions and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings or otherwise in respect of this Service are excluded to the fullest extent permitted by law.

True Knowledge excludes all liability whatever, to the fullest extent permitted by law, in respect of any loss or damage resulting or arising from any non-availability or use of this Service or of any other Service linked to it, or from reliance on the contents of this Service or any material or content accessed through it.

JURISDICTION

This Service has been designed and these terms of use shall be governed by and construed in accordance with English law. Any dispute arising out of the accessing or use of this Service shall be subject to the jurisdiction of the English courts.
